Senate defeats Repeal of Healthcare Law - Wednesday, February 2, 2011             

The Senate defeated the bill to repeal the Patient Protection and Affordable Care Act (PPACA) better known as the Healthcare law on February 2, 2011.  The House of Representatives previously passed a repeal of the Healthcare law on January 19, 2011.  We will continue to monitor the repeal effort. 


Bill to repeal Healthcare Provision requiring a Prescription for Over-The-Counter medicines for Flexible Spending Account (FSA), etc. reimbursement - February 2011 A bill was introduced to repeal the Healthcare Reform (HCR) provision that requires individuals to have a prescription for Over-The-Counter (OTC) medicines to receive reimbursement through a Flexible Spending Account (FSA), Health Reimbursement Arrangement (HRA), or Health Savings Account (HSA).  The bill would also repeal the $2500 FSA cap.

Update on Court Case Ruling - March 2011

In March of 2011, the Justice Department filed an appeal of the Court Case Decision.  (See Court Case Ruling dated Monday, January 31, 2011 below.)

Florida U.S. District Judge Vinson declared unconstitutional a key provision of the Patient Protection and Affordable Care Act (PPACA), the "individual mandate" requiring most Americans to buy health insurance by 2014 or face penalties.

This ruling is unique because unlike the VA federal judge who ruled the individual mandate unconstitutional last month, Judge Vinson ruled that "because the individual mandate is unconstitutional and not severable, the entire Act must be declared void."  Judge Vinson also stated that "Congress exceeded the bounds of its authority in passing the Act with the individual mandate."  This ruling will likely be a Supreme Court challenge.

Note:  The states bringing suit are Alabama, Alaska, Arizona, Colorado, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Maine, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Ohio, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Washington, Wisconsin, and Wyoming.

Court Ruling

Virginia Court declares the mandate that individuals buy health insurance unconstitutional.  This decision will probably be appealed and potentially sent to the United States Supreme Court for review.
